Court dismisses joinder bid in PDP 2025 Convention suit

Justice Ladiran Akintola of the Oyo State High Court, Ibadan, has dismissed a Motion on Notice seeking joinder in a suit over the 2025 Peoples Democratic Party (PDP) elective convention held in Ibadan.

The application was filed by Austin Nwachukwu and two other PDP chieftains.

In his ruling, Justice Akintola held that the motion lacked merit. He said since the PDP is already a defendant in the suit filed by Folahan Malomo Adelabi against the party’s Chairman, Damagum, and Rt. Hon. Umaru Fintiri, it was neither necessary nor desirable to join other party members.

“The PDP is a defendant in the ongoing suit… it is neither necessary nor desirable for any of its members to be joined as a party in the same suit,” the judge ruled, dismissing the application.

Counsel to the defendants, Musibau Adetunmbi (SAN) and Durosaro, had urged the court to dismiss the motion for lack of merit.

However, counsel to the applicants, Sunday Ibrahim (SAN), argued that his clients were defendants in a related suit at the Federal High Court, Ibadan, which was decided in their favour. He maintained that they ought to be joined as interested parties in the present case.

The court dismissed the application in its entirety.

Ibrahim has since appealed the ruling and filed a motion seeking a stay of proceedings pending the appeal.

Adetunmbi (SAN) also filed a motion to amend the originating summons in Suit No. 1/1336/2025.

Justice Akintola said the date for ruling on the pending applications would be communicated to counsel.
