Court warns foreign businessman against violating restraining order on Abuja property

A High Court of the Federal Capital Territory (FCT) sitting in Maitama has warned a foreign businessman, Fadi Alloush, and his associate, Ishioma Faith Gomenti, against violating a subsisting order restraining them from forcefully taking over a multi-million Abuja property.

The warning is contained in a fresh court document - Form 48 - issued by the court's Registrar.

In the document titled "Notice of consequences of disobedience to order of court," the court said: "Take notice that unless you obey the direction contained in the order made by Honourable Justice H. Muazu on 27th May 2025, you will be guilty of contempt of court and be liable to be committed to prison."

The issuance of the Form 48 by the court was sequel to a complaint from a firm - O. A. U. Parks & Garden Ltd - (now represented by Ehiogie West-Idahosa, SAN), that despite the restraining order, Alloush and Gomenti have allegedly proceeded with their plan to forcefully acquire its property located in the Mabushi area of the FCT.

Justice Muazu had, in a ruling on May 27, 2025, on a motion marked: M/5368/2025 filed by O.A.U. Parks & Garden Ltd, in its substantive suit, marked: FCT/HC/CV/1506/2025, issued the order, restraining Alloush, Gomenti and their agents from among others, tampering with the "property known as Park No. 1523A, Mabushi District, off Ahmadu Bello Way, FCT Abuja," until the determination of a pending motion on notice.

The judge equally issued another order, restraining Alloush, Gomenti, Savi, and an unknown person "from taking any further steps concerning the subject matter of this suit and or to maintain status quo" until the determination of the pending motion on notice.

Listed as defendants in the suit are the Minister of the FCT, Abuja Metropolitan Management Agency - Department of Parks and Recreation, Alloush, Gomenti, Savi, and an unknown person.

The claimant stated, in the statement of claim, that it acquired the said property in 2007, paid all the necessary fees, met all the conditions set by the relevant agencies of the FCT Administration, expended huge sums in its development, and had been in peaceful possession until April 4, 2025.

It said: "On the 4th of April, 2025, at about 9:00 pm, the claimant received calls from some of the security personnel stationed on the property, that the defendants and their cohorts invaded the property and destroyed all blocks on the sites, including materials.

"The defendants have continued to interfere with the claimant’s quiet enjoyment of the property. The unlawful acts of the defendants have continued to prevent the claimant from using the lands or to exercise the right over the said land."

The claimant is praying the court for, among others, a declaration that it is the sole bona fide owner of the land known as Park No: 1523A, Mabushi District, off Ahmadu Bello Way, FCT, covered by conveyance of approval, dated November 8, 2013, with file number: AMMA/P&R/S 500.

It also wants an order of perpetual injunction, restraining the defendants and their agents from further trespassing, reallocating, taking possession, or erecting any structure on the said land.
