Al-Barka estate: Court restrains Golden bird, others

An FCT High Court has restrained a firm, Goldenbird Investment Ltd and other unknown persons from interfering with the rights and ownership or possession of the lands for the Al-Barka Estate in Wuye, Abuja, until the determination of the suit.

The court directed that until the determination of the substantive claim by the claimants/applicants: Promiseland Building and Construction Ltd, Havencourt Apartment Ltd and En-Rose Nigeria Ltd, the defendants shall not interfere with the allotted Wuye plots.

The judge granted “an order of interim injunction restraining the Defendants/Respondents their agents, servants, privies, representatives, assigns or whatsoever and howsoever called from interfering with the rights, ownership, or possession of the claimants over the said plots 1841, 1842, 1843 and 1844, Cadastral zone B03, Wuye District, Abuja pending the hearing and determination of the clamaints/applicants motion on notice already pending before the court.”

The order followed an ex-parte application brought by Promiseland Building and Construction Ltd, Havencourt Apartment Ltd and En-Rose Ltd seeking an order of interim injunction restraining the defendants/respondents, their agents, servants, privies, representatives, assigns, or whatsoever and howsoever called from interfering with the rights and possession of the land.

Chairman and Chief Executive Officer of Promiseland Ltd, Dr Lawrence Emmanuel, said the firm was not restrained by the court in its order on the suit with number FCT/HC/CV/216/26 and motion number FCT/HC/M/685/26.

“At no time did the court restrain or prohibit Promiseland Building and Construction Limited from carrying out development or enjoying other ownership rights in respect of its Al-Barka project.

“On the contrary, the order protects our proprietary and possessory interests.

“Accordingly, any suggestion that our company has been restrained, sanctioned, or stopped from developing the property is misleading, unfounded, and should be disregarded by the public,” he said.

He further advised the public to do due diligence by verifying title ownership from the Abuja geographical information system and the FCDA Department of Development Control.
