NDPC investigates Temu for alleged violation of Data Protection Act

The Nigerian Data Protection Commission (NDPC), has initiated investigation into alleged data violation by Temu, a well known e- commerce platform. 

According to a statement signed by the NDPC Head of Legal, Enforcement and Regulations, Mr Babatunde Bamigboye, the National Commissioner/CEO of NDPC, Dr Vincent Olatunji ordered the immediate investigation of the data processing activities of Temu.

Bamigboye said in the statement that the activities of Temu may be in violation of the NDP Act.

The Commission said the investigation was triggered by concerns around online surveillance through personal data processing, accountability, data minimisation requirement, transparency, duty of care and cross-border data transfer.

The Commission further noted that preliminary investigations indicate that Temu is an e-commerce platform which processes personal information of approximately 12.7 million data subjects in Nigeria with 70 million daily active users globally. 

The Commission warned that processors who engage in processing activities on behalf of data controllers without verifying their compliance with the NDP Act may be liable under the NDP Act.
