Alleged attempted murder: AGF may revoke bail of ex-NUPENG leader

Office of the Attorney General of the Federation has applied to a High Court of Federal Capital Territory to revoke the bail granted to a former leader of Petroleum Tanker Drivers branch of Nigeria Union of Petroleum and Natural Gas Workers, Lucky Osesua.

Osesua is among 20 former leaders of PTD-NUPENG being prosecuted by OAGF before Justice Halilu Yusuf on charges of attempted murder and related offences.

Yesterday, prosecuting lawyer, David Kaswe, applied for revocation of Osesua’s bail on the grounds that he allegedly breached the terms and conditions of his bail.

But defence lawyer, Christopher Oshomegie (SAN), objected to Kaswe’s application.

Oshomegie said: “Why are they asking that their bail be revoked when they have been denied access to the depots? It is inhumanity to demand that their bail be revoked.

“What have they done? What offence have they committed that you are asking that their bail be revoked?”

Justice Yusuf agreed with Kaswe, saying there was no inhumanity in the request.

The judge said: “He (prosecuting lawyer) has right to ask that I revoke a bail, but he ought to have shared with you.

“I always tell defendants that your relationship is between you and the court, not your lawyer. Bail is your right but on terms that you don’t breach the agreement.

“So, I insist that Kaswe hasn’t done anything wrong by bringing it to my attention. He should have informed me or written formally to the court. So, Kaswe hasn’t done anything wrong. I am the judge here.
